Development application for Child Minding Centre, Beenyup Road, Byford

Background

On 24 December 2018, the Metro East Joint Development Assessment Panel (JDAP) approved (subject to conditions) a service station, car wash, vehicle service/tyre centre, showroom/restricted retail and carpark at Lot 104 Larsen Road, Byford.

Since that time, the applicants have continued to evaluate the financial viability of the project and at the same time, other alternative development options.

The purpose of this application is to seek an extension of the period within which the previously approved development must be substantially commenced. As the development was not substantially commenced by the end of the approval period, being 24 December 2022, the approval expired pursuant to regulation 17 of the Planning and Development (Development Assessment Panels) Regulations 2011 (DAP Regulations).

Therefore, the applicant seeks that the period in which to substantially commence the approved development is extended by an additional 2 years from the date of determination of this DAP Form 2 application.

If approved, the development would be required to be commenced by 24 December 2024.

The proposed development has not changed from the approved development in 2018.
